CONNEQT One-Year Limited Warranty

This One-Year Limited Warranty ("Limited Warranty") is provided by CONNEQT, Inc., a Delaware corporation with its principal office at 184 Shuman Blvd, Suite 515, Naperville, Illinois 60563 ("CONNEQT"), for only the Products described below.
1. Who and what are covered
This Limited Warranty covers a new CONNEQT PULSE device obtained directly from CONNEQT for personal, family, or household use in the United States, together with the cuff and USB charging cable originally supplied in its retail package. It also covers a new CONNEQT-branded cuff or accessory purchased separately and directly from CONNEQT (each a "Product"). It applies to the original consumer end user or the initial recipient of the Product as a gift and is not transferable after that initial transfer, except where applicable law requires broader coverage.
Coverage is limited to defects in materials and workmanship that arise during ordinary intended consumer use.
Product eligibility and intended use are determined by the final approved warranty and the controlled labeling and instructions applicable to the Product model and supplied or made available to the consumer. Before release, Quality/Regulatory must identify the controlling document names and revisions and confirm that this Limited Warranty does not conflict with them. A later website or document update does not retroactively narrow an already-issued warranty, except to the extent required by a lawful safety or regulatory action.
2. Warranty period
The warranty period is one year from the Product's original purchase date. A repaired or replacement Product is covered for the remainder of the original Product's one-year warranty period, unless applicable law requires a longer period.
3. Remedy
For a valid claim, CONNEQT will, at its option and as the consumer's exclusive contractual remedy under this Limited Warranty:
- repair the Product; or
- replace the Product or defective component with a new or reconditioned functional equivalent.
A reconditioned replacement must be inspected, tested, and released under the applicable medical-device quality procedures to meet the original manufacturer's safety and performance specifications and original intended use. A replacement may differ cosmetically or use updated components while providing materially equivalent functionality and satisfying applicable regulatory requirements. CONNEQT may require return of the affected Product before providing a remedy, subject to applicable service procedures and law.

Provide reasonable proof of purchase, the Product and serial number if available, the original purchase date, a description of the issue, and information reasonably needed to evaluate the claim. Follow CONNEQT's return, packaging, safety, and shipping instructions. CONNEQT will provide authorized return-shipping instructions for a potentially covered claim.
For a potentially covered claim, CONNEQT will provide a prepaid return label or another authorized no-cost return method. If the claim is covered, CONNEQT pays the authorized inbound and outbound shipping. If inspection determines that the claim is not covered, CONNEQT will disclose any return-shipping charge before it is incurred. A consumer retains any shipping or service right that applicable law does not permit this Limited Warranty to restrict.
A prospective buyer or current owner may request a free paper copy of this Limited Warranty through the email, mailing address, or telephone number above.
Do not send a Product without authorization. Remove personal items and, where practical, back up or export information you want to keep before service. Repair or replacement may result in loss of locally stored settings or data.
5. Exclusions
To the extent permitted by law, this Limited Warranty does not cover:
- normal wear, cosmetic damage, or expected aging;
- ordinary depletion, wear, or deterioration of a rechargeable battery, cuff, cable, accessory, or another consumable component, but not a defect in a covered component;
- a defect or damage caused by misuse, abuse, neglect, accident, liquid, contamination, improper cleaning, improper storage or charging, puncture, crushing, dropping, fire, smoke, abnormal heat or cold, or another external cause;
- a defect or damage caused by use contrary to the intended purpose, labeling, warnings, instructions, contraindications, or user limitations;
- a defect or damage caused by unauthorized modification, tampering, disassembly, repair, or removal or alteration of a serial number;
- a defect or damage caused by an incompatible or unauthorized device, network, charger, accessory, software, or service;
- connectivity, mobile-device, operating-system, internet, cloud-service, app-service, or third-party-service issues that are not caused by a Product defect;
- dissatisfaction with a subjective experience, report, assessment, reading, or expected wellness outcome;
- loss or damage during an unauthorized or improperly packaged return; or
- a Product obtained from an unauthorized seller.
This Limited Warranty does not cover a separate subscription, Care+ entitlement, app-store purchase, consumable credit, or other digital service. Those items are governed by the applicable offer and service terms.
6. Implied warranties and state rights
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
CONNEQT does not disclaim an implied warranty that applicable law does not permit it to disclaim. TO THE EXTENT APPLICABLE LAW PERMITS THE DURATION OF AN IMPLIED WARRANTY TO BE LIMITED, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR SIMILAR IMPLIED WARRANTY IS LIMITED TO THE ONE-YEAR DURATION OF THIS LIMITED WARRANTY.
Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
No unauthorized third-party statement creates or expands this Limited Warranty. Nothing in this Limited Warranty negates an express warranty, product description, affirmation of fact, sample, model, or official labeling that applicable law treats as part of the transaction. No non-waivable warranty, labeling obligation, safety obligation, right, or remedy is disclaimed or limited.
7. Limitation of damages
TO THE EXTENT PERMITTED BY LAW, CONNEQT WILL NOT BE LIABLE UNDER THIS LIMITED WARRANTY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Nothing in this Limited Warranty excludes or limits liability that cannot lawfully be excluded or limited, including applicable personal-injury or product-liability rights.
8. Relationship to product terms
The CONNEQT Consumer Product Terms govern the sale, delivery, returns, and use of a Product.
This Limited Warranty does not itself require a consumer to use a separate informal dispute-settlement mechanism before asserting rights under federal warranty law.
9. No personal undertaking
This Limited Warranty is provided solely by the warrantor identified in the final approved introductory paragraph. No officer, director, employee, affiliate, contractor, or agent assumes a personal warranty or payment obligation merely by acting or communicating for that warrantor.
